Terms of Service

Last updated September 23, 2026

These terms are an agreement between you and OutTheChat (“we”, “us”) for using the OutTheChat mobile app and this website (together, the “Service”). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.

The short version

  • Be at least 13, keep your account secure, and be respectful to other people.
  • You own what you post. You let us store and show it so your trip group can use it.
  • We don’t handle money. Splits are a record between friends; you settle up yourselves.
  • AI suggestions, travel times and place details can be wrong. Double-check before you rely on them.
  • Follow our Community Guidelines. We can remove content and restrict or disable accounts that don’t.

1. Who can use OutTheChat

You must be at least 13 years old. If you’re under the age of majority where you live, you need a parent or guardian’s permission, and they agree to these terms for you. You can’t use the Service if you’re barred from doing so by law, or if we’ve previously closed your account for breaking these terms.

2. Your account

Give accurate information when you sign up, keep your password private, and tell us at getoutthechatapp@gmail.comif you think someone else is using your account. You’re responsible for what happens under your account. One person per account; don’t impersonate anyone or pick a username that misleads people about who you are.

3. Your content

“Your content” means anything you add to the Service: messages, photos, plans, expenses, documents, links and anything else. You keep ownership of it. So that the Service works, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, display and send your content, only to run, improve and protect the Service and as described in the Privacy Policy. This licence ends when your content is deleted, except for copies other people still need, such as trip chat messages and shared expenses (see the Privacy Policy), and routine backups until they expire.

You’re responsible for your content and must have the right to share it, including photos of other people and documents you upload for your group. Anything you post in a trip or group chat is visible to its members.

4. Community Guidelines

OutTheChat is for planning trips with people you know. Keep it safe and respectful. These guidelines apply to everything you post, send or share, including messages, photos, profile details, plans, boards and documents. We have zero tolerance for objectionable content or abusive users.

You must not post, send or share content that:

  • Harasses or bullies. Threats, intimidation, degrading or shaming someone, unwanted repeated contact, or encouraging others to do any of these.
  • Is hateful. Attacks on people based on race, ethnicity, national origin, religion, caste, sex, gender, gender identity, sexual orientation, disability or serious illness, including slurs, dehumanising language and hateful symbols.
  • Threatens or glorifies violence. Credible threats, calls for violence, graphic or gory content shared to shock, or support for terrorist, violent extremist or criminal organisations.
  • Is sexual or nude.Nudity, sexual activity or sexually explicit content; sexual solicitation; and, without exception, any content that sexualises or exploits minors, which we report to the National Center for Missing & Exploited Children and law enforcement.
  • Shares intimate or private material without consent. Intimate images of anyone without their consent, or threats to share them.
  • Encourages self-harm. Content that promotes or encourages suicide, self-injury or eating disorders.
  • Sells or promotes regulated or dangerous goods. Buying, selling or trading drugs, weapons, ammunition, explosives, alcohol or tobacco, or promoting dangerous acts.
  • Is fraud, a scam or spam. Fake debts or payment requests, phishing, pyramid schemes, fake giveaways, misleading links, or bulk or repetitive unwanted messages.
  • Violates privacy.Sharing someone’s personal information, location, documents, payment details or photos of them in private spaces without their permission.
  • Impersonates or misleads. Pretending to be another person, brand or organisation, or using fake accounts.
  • Infringes intellectual property.Content you don’t own or have permission to use, such as other people’s photos, music or trademarks.
  • Is illegal or harmful to the Service. Anything that breaks the law, and any attempt to upload malware, scrape data, overload the Service or get around its security or these guidelines.

Reporting

If you see something that breaks these guidelines, or someone is bothering you, email getoutthechatapp@gmail.comwith the username, the trip, and what happened (screenshots help). We review reports within 24 hours. Reports are confidential: we don’t tell the person who reported them. If someone is in immediate danger, contact local emergency services first.

How we enforce them

We may remove or restrict any content, and warn, limit, suspend or permanently disable any account, that we believe breaks these guidelines or these terms, or that creates risk or legal exposure for us or other people. We decide at our discretion, and for serious or repeated violations we may act immediately and without notice. People whose account we disable may not create a new one. We may preserve content and share information with law enforcement where the law requires it or where we believe someone is at risk of harm.

If you think we made a mistake, email getoutthechatapp@gmail.comand we’ll take another look.

Copyright complaints

If you believe content on OutTheChat infringes your copyright, email getoutthechatapp@gmail.comwith: your contact details, a description of the work, where the content appears in the app, a statement that you have a good-faith belief the use isn’t authorised, and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for them, with your physical or electronic signature. We remove infringing content and disable the accounts of repeat infringers.

5. Splitting costs and payments

OutTheChat helps groups keep track of who paid for what. We are not a bank, payment processor or money transmitter, and we never hold, send or receive money. When you choose to pay someone, the app opens a separate service such as Venmo, Cash App or your bank’s Zelle, and that payment is between you, the other person and that service, under its own terms.

Balances, splits, exchange rates and reminders are calculated from what group members enter and are provided for convenience. Check amounts before you pay. We’re not responsible for mistakes in amounts people entered, for payments made or not made, or for disagreements between group members about money.

6. Travel information and AI features

Place details, opening hours, photos, travel times, exchange rates and AI-generated suggestions come from third parties and automated systems. They may be incomplete, out of date or wrong. Always check important details (bookings, opening hours, prices, safety, visa and entry rules) with the original source before you rely on them. Use of AI features is optional; don’t send anything through them you wouldn’t want processed by our AI providers, as described in the Privacy Policy.

Links and in-app browsing to third-party sites such as booking sites take you to services we don’t control. Any booking or purchase you make there is between you and that business.

7. Location sharing

Sharing your live location with a trip is optional and you can turn it off at any time. Only share with people you trust, and don’t rely on the map for your safety: locations can be delayed, inaccurate or unavailable.

8. Our Service

The Service, including the app, its design, name and logo, belongs to us and our licensors. We give you a personal, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial use, under these terms. Don’t copy, modify, resell or reverse-engineer the Service except where the law allows it.

We may add, change or remove features at any time, including introducing paid features or subscriptions. If you buy something in the app, the price and terms are shown before you pay, and purchases made through the App Store or Google Play are also governed by their terms. We may update the app, and some features need an internet connection.

9. Ending your account

You can delete your account at any time in the app under Profile → Privacy, or from our account deletion page. We may suspend or disable your account at any time, with or without notice, if you break these terms or our Community Guidelines, if we’re required to by law, or if we stop offering the Service. Sections 3 (the part about shared records), 5, 6, 10, 11 and 13 continue to apply after your account ends.

10. Disclaimer

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we don’t promise that it will always be available, error-free or secure, or that information in it is accurate, and we disclaim all implied warranties, including of merchantability, fitness for a particular purpose and non-infringement. Nothing in these terms limits rights you have under consumer protection laws that can’t be excluded.

11. Limitation of liability

To the fullest extent the law allows, we aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, missed travel or bookings, or disputes between users. Our total liability for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US$50. Some places don’t allow these limits, so they may not apply to you.

If you break these terms or the law and someone makes a claim against us because of it, you agree to cover our reasonable costs from that claim, to the extent the law allows.

12. App Store and Google Play

If you downloaded the app from Apple’s App Store: these terms are between you and us, not Apple. Apple isn’t responsible for the app or its content, has no obligation to provide maintenance or support, and, to the extent the law allows, has no warranty obligation for the app beyond refunding any purchase price if the app fails to meet a warranty. We, not Apple, are responsible for any claims about the app, including product liability, legal or regulatory requirements, consumer protection and intellectual property claims. You confirm you’re not in a country subject to a US government embargo or on a US list of prohibited parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If you downloaded the app from Google Play, Google Play’s terms also apply to that download.

13. General

These terms are governed by the laws of the State of Alabama and applicable United States federal law, without regard to conflict-of-law rules. Any legal claim that isn’t resolved informally will be brought in the state or federal courts located in Alabama, and you and we agree to their jurisdiction. If you live outside the United States, this doesn’t take away any protection you have under the mandatory consumer laws of the country you live in. Before starting any legal claim, please email us at getoutthechatapp@gmail.com so we can try to sort it out informally.

If part of these terms can’t be enforced, the rest still applies. If we don’t enforce a part right away, we haven’t given up the right to later. You can’t transfer your rights under these terms without our permission; we may transfer ours as part of a merger, sale or reorganisation. These terms and the Privacy Policy are the whole agreement between you and us about the Service.

14. Changes to these terms

We may update these terms. If a change is important, we’ll tell you in the app before it takes effect and update the date at the top of this page. If you keep using the Service after that, you accept the new terms; if you don’t, you can delete your account.
